The thermal and under-voltage throttling is implemented in the firmware in the boards SPI flash. It's independent of the OS.
Different operating systems may have different CPU performance governors selected in the kernel which could explain what you are seeing.
Thermal throttling only activates above 80C. The bcmstat utility is pretty useful for monitoring the voltage/temperature and clock frequencies
